Effective September 15, 2000 the U.S. Department of Housing and Urban Development implemented sections 1012 and 1013 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (24 CFR Part 35). These sections include new rules for addressing lead-based paint hazards and for ensuring that housing receiving federal assistance does not pose a lead-based paint hazard to young children.
These rules require significant changes in the identification, treatment and documentation of lead hazards in HUD funded housing and related activities. The changes enacted affect the following activities: rehabilitation; tenant-based rental assistance; and acquisition, leasing, support services and operations.
The new regulations organize requirements by type of activity and base requirements on the amount of Federal funding involved in a project. The regulation identifies five requirements needed to properly address lead-based paint: notification, lead hazard evaluation, lead hazard reduction, ongoing maintenance, and response to children with environmental intervention blood lead level.
