The Texas Department of Housing and Community Affairs, Manufactured Housing Division (Department) has implemented a new procedure which may require licensees to attend a Director’s Disciplinary Meeting. These meetings are held when it is discovered that a manufacturer, retailer or installer fails or refuses to provide warranty service in accordance with a Department Order under Section 1201.356 of the Texas Occupations Code.
When an alleged violation of a warranty service Order is discovered the Director shall hold an informal meeting at which the manufacturer, retailer, or installer must show cause as to why the manufacturer’s, retailer’s or installer’s license should not be suspended or revoked and at which time the consumer may express the person’s views pursuant to Section 1201.357 of the Texas Occupations Code. Both the licensee and the consumer will be issued notice of when the Director’s Disciplinary Meeting will take place. The Director’s Disciplinary Meeting will be held in the Department’s Austin Office located at the George HW Bush Building, 1801 Congress Ave., Suite 11.400, Austin, Texas 78701.
Following the meeting, the Director shall either resolve the matter by agreed order, dismiss the matter if no violation is found to have occurred, or institute an administrative action, which may include license suspension or revocation, the assessment of administrative penalties or a combination of such actions. An administrative penalty may be assessed in an amount not to exceed $10,000 for each violation.
